Acceptance of Terms

By accessing, browsing or purchasing from Pepceuticals ("Pepceuticals", "we", "us", "our"), you agree to be legally bound by these Terms of Service, our Privacy Policy, Shipping Policy and any other policies published on this website.
If you do not agree with these Terms, you must immediately discontinue use of this website.

Australian Consumer Law

These Terms operate subject to the Competition and Consumer Act 2010 (Cth) including Schedule 2 – Australian Consumer Law (ACL).
Nothing contained within these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under Australian law.

Eligibility

By placing an order you warrant that:
You are at least 18 years of age.
You possess the legal capacity to enter into binding contracts.
All information provided is accurate and complete.
You are purchasing products for lawful purposes only.
You will comply with all applicable Commonwealth, State and Territory laws.

Research Use Only

All products supplied by Pepceuticals are sold strictly for laboratory research purposes only.
Products are NOT:
intended for human consumption;
intended for therapeutic use;
intended for medical treatment;
intended for diagnosis;
intended for veterinary use;
intended to prevent, treat or cure disease.
By purchasing you acknowledge and agree that:
you understand the intended research purpose of the products;
products will only be handled by appropriately trained persons;
you assume all responsibility for handling, storage and use;
Pepceuticals accepts no responsibility for misuse.

Product Information

Unless otherwise stated, products are supplied as lyophilised (freeze-dried) compounds.
Normal characteristics include:
colour variation;
crystallisation;
compact or uneven lyophilised cakes;
powder adhering to vial walls;
slight shrinkage during freeze-drying;
blue or darker pigmentation in copper-containing compounds such as GHK-Cu.
These characteristics do not constitute defects.
Products are dispatched:
sealed;
sterile (where applicable);
stored under appropriate refrigerated conditions prior to shipment.

Product Availability

Products are offered subject to availability.
We reserve the right to:
discontinue products;
alter packaging;
amend specifications;
limit purchase quantities;
refuse supply at our discretion.
Images are provided for illustrative purposes only and may differ slightly from supplied products.

Pricing

All prices are displayed in Australian Dollars (AUD).
We reserve the right to:
correct pricing errors;
update prices without notice;
cancel orders affected by obvious pricing mistakes.
Where an incorrect price has been charged, customers will be offered either:
a full refund; or
the opportunity to proceed at the correct price.

Orders & Payment

Orders are accepted only once payment has been successfully received.
Pepceuticals reserves the right to refuse, cancel or limit any order where:
fraud is suspected;
inaccurate information has been supplied;
products become unavailable;
legal or regulatory concerns arise.
Refunds for cancelled orders will be processed using the original payment method.

Shipping & Delivery

Estimated delivery times are provided as guides only.
Once dispatched:
risk passes to the customer;
delivery is managed by Australia Post or our nominated courier;
delays outside our control do not constitute breach of contract.
Pepceuticals is not liable for delays resulting from:
customs processing;
courier delays;
weather events;
industrial action;
public holidays;
incorrect delivery information supplied by the customer.

Refunds, Returns & Australian Consumer Law

Change of Mind
We do not provide refunds or exchanges for:
change of mind;
incorrect ordering;
misunderstanding of product appearance;
failure to read product descriptions.

Product Appearance
Products are not considered faulty where they:
match the product description;
remain sealed;
exhibit normal freeze-dried characteristics;
display expected colour variations.

Inspection
Where a customer believes a product is faulty:
they must contact us promptly;
products may need to be returned for inspection;
return shipping is generally the customer's responsibility unless otherwise required by law;
products must remain sealed unless instructed otherwise.
We reserve the right to inspect products before determining the appropriate remedy.

Consumer Guarantees
Nothing within these Terms limits your rights under Australian Consumer Law.
Where products fail to comply with statutory consumer guarantees, customers may be entitled to:
repair;
replacement;
refund;
as determined under the Australian Consumer Law.

Major & Minor Failures
Where a product experiences:
Major Failure
Customers may choose:
replacement; or
refund.
Minor Failure
Pepceuticals may elect to:
repair;
replace; or
otherwise remedy the issue,
in accordance with Australian Consumer Law.

Intellectual Property
All intellectual property appearing on this website including:
logos;
branding;
product photography;
graphics;
website design;
written content;
trademarks;
remains the exclusive property of Pepceuticals or its licensors.
No material may be copied, reproduced, distributed or used without prior written consent.

Website Use
You agree not to:
interfere with website security;
introduce malware;
scrape or harvest data;
attempt unauthorised access;
use the website unlawfully.
We reserve the right to terminate access without notice where misuse is identified.

Limitation of Liability
To the maximum extent permitted by law:
Pepceuticals shall not be liable for:
indirect losses;
consequential losses;
loss of profits;
business interruption;
loss of opportunity;
incidental damages.
Where liability cannot be excluded, it shall be limited to the extent permitted under Australian law.
Nothing in these Terms excludes statutory rights under the Australian Consumer Law.

Indemnity
You agree to indemnify and hold harmless Pepceuticals, its directors, employees, contractors and affiliates against any claims, liabilities, losses, costs or expenses arising from:
misuse of products;
breach of these Terms;
unlawful conduct;
negligent handling of products.

Chargebacks & Payment Disputes

Customers agree to contact Pepceuticals before initiating a payment dispute.
Where a chargeback is initiated, we may provide payment providers with relevant evidence including:
order history;
communications;
tracking information;
policies accepted during checkout;
delivery confirmation.
Fraudulent chargebacks may be referred to debt recovery or legal representatives where appropriate.

Privacy

Personal information is collected and managed in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
We take reasonable measures to safeguard customer information.

Force Majeure
Pepceuticals shall not be liable for any failure or delay in performing obligations where such failure results from events beyond our reasonable control, including but not limited to:

Electronic Communications

By using this website or placing an order, you consent to receiving communications electronically, including order confirmations, invoices, notices and updates.

Continued use of the website constitutes acceptance of the revised Terms.
